This report was written by Mr. FONDO Arcenio Hafo Arlindo from Mozambique. After obtaining a Master of Laws (LL.M.) degree from the Graduate School of Law at Kyushu University, the author was working as an intern at OSINTech at the time of writing this report.

Summary

The purpose of this report is to comprehensively examine the rule-making process within Mozambique’s foreign direct investment (FDI) legal framework, identify key challenges, and propose practical lessons for future reforms.

Despite Mozambique’s abundant natural resources and strategic geographic advantages, its FDI policies are often undermined by an inadequate regulatory framework, insufficient stakeholder engagement, and inconsistent governance. The report examines key sectors such as energy, transportation, and telecommunications, demonstrating whether existing regulations promote or hinder investment.

The author emphasizes the importance of a well-structured FDI framework that not only attracts investment but also promotes sustainable development and ultimately contributes to Mozambique’s long-term economic growth. He concludes that sustainable reform requires a shift from ad hoc, top-down decision-making to a rule-making process characterized by transparency, participation, and consistency.
