[Report]Rulemaking in South Sudan: The Dynamics of Legislative Processes at the Local Government Councils in South Sudan

1 min read

The purpose of this report is to analyze the rule-making process within the South Sudan Local Government Council—that is, its formal and informal legislative and decision-making processes.

South Sudan’s governance structure is deeply rooted in a long history of local decentralization, which traces back to the administrative model inherited from Sudan. Although the Interim Constitution and the Local Government Act provide a clear legal basis for local legislation, formal procedures are often undermined by a lack of institutional capacity, political influence, and limited civic participation; as a result, ordinances are said to lack both validity and legality.

The author concludes that future progress must prioritize a sincere commitment to policy formulation, capacity building for councils and civil society stakeholders, and the development of clear tools for dialogue and accountability, and that consideration should also be given to stabilizing the integration of customary authority and the statutory framework.
